By downloading, installing, and using Driveely ("the Application"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, please do not use the Application.
Grant of License
We grant you a limited, non-exclusive, non-transferable, revocable license to use Driveely solely for personal, non-commercial purposes on your mobile device.
Permitted Use
You may:
• Use the Application to track vehicle expenses and fuel consumption
• Export your data in CSV format for personal backup or analysis
Prohibited Use
You may not:
• Reverse engineer, decompile, or attempt to extract source code
• Modify or create derivative works
• Rent, lease, or lend the Application
• Use the Application for commercial purposes
• Attempt to circumvent any technical protection measures
Data Entry Accuracy
You are responsible for the accuracy of all data you enter into the Application
We are not responsible for any errors, omissions, or inaccuracies in your data entries
Calculations and metrics are only as accurate as the information you provide
Your Data Ownership
You retain full ownership of all data you create in the Application
All vehicle and expense data belongs to you
Driveely does not claim ownership of your data
Data Storage
Your data is stored exclusively on your device in a local database
You are responsible for maintaining a backup of your data if needed
We recommend exporting your data regularly for safekeeping
No Warranties
Driveely is provided "AS IS" without any warranties, express or implied, including:
• Merchantability
• Fitness for a particular purpose
• Accuracy or reliability of calculations
• Uninterrupted or error-free operation
Data Loss
We are not responsible for:
• Loss of data due to device malfunction
• Data loss from uninstalling the Application
• Data loss from device failure or corruption
• Any interruption of service
Liability Cap
Our total liability shall not exceed the amount you paid for the Application (if any). Some jurisdictions do not allow limitations of liability, so this may not apply to you.
Exclusion of Damages
In no event shall Driveely be liable for:
• Indirect, incidental, special, or consequential damages
• Lost profits, data, or business interruption
• Any damages arising from your use or inability to use the Application
• Third-party claims
We will make reasonable efforts to identify and fix bugs when reported
We are not obligated to provide specific timelines for bug fixes
You can report issues through the in-app feedback mechanism
Sentry may collect crash reports to help us improve the Application
Service Modifications
We reserve the right to:
• Add, remove, or modify features
• Change the functionality of the Application
• Update the user interface or experience
• Discontinue the Application or specific features
Service Termination
We may discontinue Driveely at any time. We will make reasonable efforts to notify users, but are not obligated to do so.
Payment Processing
Premium subscriptions are managed by Apple App Store (iOS) or Google Play (Android)
All payment processing is governed by their respective terms
We do not directly handle your payment information
Refunds are subject to App Store/Google Play policies
Subscription Cancellation
You can cancel your subscription directly through the App Store or Google Play
Cancellation policies are governed by Apple and Google, not by us
No additional cancellation conditions apply from our end
Our Property
Driveely, including its design, graphics, and code, is our property
You may not use our intellectual property without permission
Your Property
You retain all rights to your data and exported content
We do not claim ownership of information you create or input
You have the right to:
• Export your data in CSV format
• Transfer your data to another application or service
• Maintain a backup of your information
• Delete your data by uninstalling the Application
Driveely is intended for users 13 years of age or older. If you are under 13 (or the applicable age in your jurisdiction), you may not use this Application. We do not knowingly collect information from children under 13.
Driveely uses the following services:
• Sentry: For error tracking and crash reporting
• App Store / Google Play: For distribution and payments
We are not responsible for the actions or policies of these third parties. Please review their terms and privacy policies.
By using Driveely, you agree to comply with:
• Apple App Store Terms & Conditions
• Google Play Terms & Conditions
• All applicable laws and regulations
These Terms are governed by the laws of France, without regard to conflict of law principles.
Dispute Resolution
Any disputes arising from these Terms shall be resolved:
• First, through good-faith negotiation between the parties
• If unresolved, through binding arbitration or court proceedings in France
• You agree to submit to the exclusive jurisdiction of French courts
If any provision of these Terms is found to be invalid or unenforceable, that provision will be severed, and the remaining Terms will continue in full force and effect.
These Terms, along with our Privacy Policy, constitute the entire agreement between you and Driveely regarding your use of the Application.
We may update these Terms at any time. We will notify you of significant changes by updating the "Last Updated" date. Your continued use of the Application constitutes acceptance of updated Terms.
